Washington: Following the ruling by the top election authority that former President Donald Trump was disqualified due to his involvement in the January 2021 attack on the US Capitol, the US state of Maine barred him from participating in its Republican presidential primary on Thursday.
In her decision, Maine Secretary of State Shenna Bellows stated that the events of January 6, 2021 “occurred at the behest of, and with the knowledge and support of, the outgoing President.”

“The US Constitution does not tolerate an assault on the foundations of our government and (Maine law) requires me to act in response,” the order stated

Maine has joined Colorado, which eliminated Trump from its Republican primary earlier this month. These decisions will undoubtedly be contested in the US Supreme Court.

The 14th Amendment to the US Constitution, which prohibits anybody who has pledged to defend the nation and then engages in insurrection from holding public office, was cited in the verdicts in both states.

Bellows’ decision was promptly denounced by Trump’s campaign as “attempted theft of an election and the disenfranchisement of the American voter.”

According to the New York Times, Democratic Secretary of State Shirley Weber had hinted in the past several days that, depending on how she interpreted California law, she was likely to keep Mr. Trump on the ballot.

Can Trump therefore run for US President?
Despite numerous lawsuits requesting that his candidature be disqualified for his role in actions on Capitol Hill intended to void the 2020 election results. However, Section 3 takes effect without a criminal conviction, and as per the US Constitution, they couldn’t have done so without a court order—that is, until Maine Secretary of State Shenna Bellows made her judgement.

Section 3 has never been decided by the US Supreme Court. However, the Maine ruling does compel the top court to act. Maine dispels any doubt that the justices would hear the Colorado case, which was previously quite likely.

Following the Civil War, the United States ratified the Fourteenth Amendment, Section 3, which guaranteed former slaves’ rights. It was intended to prevent former Confederates from taking back control of the government following the war.

Section 3-The measure reads:

“No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.”
